Suit Filed In Federal Court for Violation of ADA by Port Clinton

For Immediate Release - June 30, 2006

The Ability Center of Greater Toledo and the wife of a deceased gentleman who used a wheelchair filed a lawsuit today in U.S. District Court against a Port Clinton restaurant for violation of The Americans with Disabilities ACT (ADA).

The suit alleges that Magi Enterprises Inc., doing business as "Phil's Inn" restaurant discriminated against Mr. Stanley Belevender, a person with a disability who uses a wheelchair, and other people who use wheelchairs or have other disabilities, under Title II of the ADA in the provision of access, seating, restrooms, and other services.

After repeated attempts to resolve the situation outside of court, the plaintiffs filed suit alleging that the management refused to make reasonable modifications and refused to remove architectural barriers to allow persons with disabilities to benefit from the restaurant's goods and services.

The suit seeks to enjoin the defendant from continuing to violate the rights of persons with disabilities under the ADA and the Ohio Revised Code and to permanently comply with all applicable provisions of the ADA, and seeks compensation for damages pursuant to the Ohio Revised Code.

The Ability Center of Greater Toledo is a not-for-profit organization providing a variety of services designed to assist individuals with disabilities to participate in their communities with the greatest possible independence. The Center offers Advocacy, Peer Support, Information and Referral, Independent Living Skills Training, Recreation and other services for youth and adults in Defiance, Fulton, Henry, Lucas, Ottawa, Wood and Williams Counties.
